Is Ted Cruz Eligible To Be President Of The United States?

Cruz's "citizenship" is not in question but, as Orly Taitz correctly points out, whether or not he meets the definition of being a "natural born citizen" is a question that needs to be settled by the courts. Taitz's insightful comments notwithstanding, we do find it comical that US News and World Report is giving Cruz's status coverage while it still refuses to address Barack Obama's lack of eligibility.

(US News) "I think that Ted Cruz is correct in addressing this issue early on and I commend it," Taitz said. She added: "not only does he need to release his birth certificate, but he needs to go to court and have a high-ranking judge ... make a determination on this issue."

Taitz, a Russian-born dentist, recommends that Cruz seek declaratory relief from a judge to determine if he qualifies as a natural-born citizen.

"If until the 2016 election we don't find one honest judge [to declare Obama ineligible for the presidency]," Taitz said, she will encourage people to vote for Cruz "if they feel he is the best candidate to turn the country around ... because we won't have any rule of law."

  1. I find it amazing that the Supreme Court has refused to review Obama and the Congress likewise, then Senator Cruz by all definition, is qualified. It was a pass for Obama and the courts and congress cannot be indifferent.

  2. "natural born" means born of two parents who are citizens whether by birth or by becoming naturalized themselves. It is the only form of royalty we have in this country. I hope it can prevail. It is in the Constitution and applies only to the office of president and vice president. Although it was an option to be checked for on draft registration in WWI in some states if not all.

  3. Ted Cruz was born in Canada to a Cuban father (I do not think he had become a Canadian citizen yet) & American mother. I believe that out Founding Fathers intended the term "natural born US citizen) to mean that to qualify to be President you should be born on US soil to US citizens. Obama fails that test (regardless of where he was born since his supposed father was NEVER a US citizen) & Cruz fails on 2 counts. Just because nobody upheld the Constitution in checking out Obama's eligibility to be President does not mean everyone else gets a "pass" after that.

  4. Much as I like Ted Cruz, I do not believe he is eligible to be president, here's why:

    1. In Article II, Section 1, Clause 5, the President is required to be a “natural born citizen,” the only place that phrase is used in the Constitution

    2. SCOTUS has ruled 4 times so far on what is a “natural born citizen.” Those rulings are:

    A. The Venus,12 U.S. 8 Cranch 253 (1814)
    B. Shanks v. Dupont, 28 U.S. 3 Pet. 242 (1830)
    C. Minor v. Happersett , 88 U.S. 162 (1875)
    D. United States v. Wong Kim Ark, 169 U.S. 649 (1898)

    In each ruling, SCOTUS has defined “NATURAL BORN CITIZEN” as follows (or similar language):

    “At common law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives or
    natural-born citizens, as distinguished from aliens or foreigners.”

    The term and definition of natural born citizens is derived from the book, “The Law of Nations,” written by Emmerich de Vattel, a Swiss-German philosopher of law, with which the founders were well familiar.

  5. If we are not allowed to question Obama's citizenship Bo is better of to be president than him. Everyone can see Bo's papers. The left has alot of nerve questioning Mr. Cruz on anything.
