Georgia Court Told Obama Slam-Dunk Disqualified
The historic hearing was the first time that a court has accepted arguments on the merits of the controversy over Obama’s status. His critics say he never met the constitutional requirements to occupy the Oval Office, and the states and Congress failed in their obligations to make sure only a qualified president is inaugurated. His supporters, meanwhile, argue he won the 2008 election and therefore was “vetted” by America.
The hearing was before Judge Michael Malihi of the Georgia state Office of State Administrative Hearings. In Georgia, a state law requires “every candidate for federal” office who is certified by the state executive committees of a political party or who files a notice of candidacy “shall meet the constitutional and statutory qualifications for holding the office being sought.”

ReplyDeleteThe difference is that Santorum's and Romney's fathers became citizens and were citizens at the time of the birth of those two. Once you have lived in the US for eight years following your naturalization, you can convey citizenship. If you were born here, you must be 18 years of age to do so.

Peeper, Santorum's father came to the U.S. at age 7. He became a citizen soon after reaching adulthood. He and Santorum's mother were American citizens at the time of Rick's birth. Rick Santorum IS a natural-born citizen.

Just look at how he breaks constitutional law on an almost daily basis & no one seems to have the balls to put a stop to it. I expect a warrant to be issued for his immediate arrest without undue delay. He willfully broke the law & he deserves to go to jail for it. I have never gotten away with not showing up for court, a bench warrant was issued before the gavel fell. If the law is the same for everyone, as we're told since childhood, I expect him to be in jail before nightfall. That would only be right. Law enforcement, enforce the law !!!!!!!!!!

The Constitution specifies that the President must have been born in the US. It says nothing about his father or mother. The question is whether Obama was born in Kenya, as Chicago papers reported when he was first elected to office, or in Hawaii.

I am guessing now, but, one reason no warrant is going forward yet is, being found not eligible to run in 2012 does not make him a law breaker. Just THAT, is not enough to "Send in the clowns... Ah, FBI!"
The Georgia Judge, or another judge (there are 3 more states already where this shall be heard), would have to rule first, "If he is inelegible now, that must make him having been inelegible since birth, therefore, he has committed fraud.", or something like that, which IS a crime.
Finally, we must go step one before step two. This is a long way farther forward than, "Case dismissed because you stupid people do not have 'standing' in my court!"
You're absolutely right, Anonymous. It's amazing how he is above the law, no matter what he does. This must stop; and soon. He was ineligible to run for the office of the U. S. Presidency in 2008, and he STILL IS. So his name should not be on ANY state's ballots.
DeleteWe can only hope that other states which have been watching from the sidelines will take this action by Georgia as motivation to do likewise. The house of cards that Obama has been living in for at least the past 4 years (actually longer) could finally come tumbling down and sink him along with the demonic-rat party in 2012. Arizona and Alabama, the two sovereign states that have been sued by Obama's Justice Department in federal court for daring to enact legislation to curb illegal immigration in accordance with federal law, are two likely states that could and should move on it without delay. Obama's race card may finally have reached its credit limit. We can only hope.

Well, this right-winger has at least READ the Constitution - which obviously you have not. Article II, Section 1 clearly handles that situation by stating "...a natural born Citizen, or a Citizen of the United States at the time of Adoption of this Constitution..." And by the way, the requirement for natural born Citizen is far from just an opinion. It had a valid meaning that was well understood by the Framers, that being a person born of a Father and Mother who were both Citizens of the Country wherein the child was born. This definition was also confirmed by the US Supreme Court in Minor v. Happersett, Mar 29, 1875. GOOGLE IT!

Unless we're going back to the silly birth certificate argument, the one citizen parent interpretation applies.

They presumed he was eligible by virtue of the fact that it was presumed he was vetted appropriately. Those of us who did not vote for him did not vet him. As a matter of fact, I exposed him before he was even put in as a candidate and my rights were violated as an American citizen when he was pushed through the process without meeting the requirements.

We were not capable and neither are they. They go along with the crowd. We all know that. Only citizens should be allowed to vote, only those who are working and paying taxes. No person should be allowed to vote if he or she is on welfare and the goverment is making their living. they would be working if they knew how to make a good decision. A majority of the country voted for Obama. You think they are all "dumb." So more than half of the country is dumb...meanwhile, John McCain and Sarah Palin would have saved the country from a deep recession. Right. I get the logic here....oh wait, there is no logic or rational argument made.
Truth is that the recession would have been ugly no matter who was president. Obama certainly made it no better, and indeed probably made it worse, but we would not be back to the glory days regardless. Bush left the country in a total mess - two wars that weren't paid for, a Medicare prescription plan that wasn't paid for, and a rash of half-brained decisions made by a half-brained man. The country wanted anyone else besides a president with an R next to his/her name.
And this circus act of a nomination process is shaping up to be just what Obama wanted. Village idiots bashing each other, none of them with a plan to turn it around.
So the Bubbas of the world have resorted to this natural citizen garbage as their only hope. No doubt it is their only hope, even if that hope is infinitesimal indeed. Might as well buy a lottery ticket while you're at it...you have just as much chance of that working out in your favor.
I think we should just abandon all elections and make you the dictator. We could all live by Bubba's rules. We could rename the country Bubbaland, all drive trucks, and moan about how the black man stole our freedom.
